These Terms of Service (“Terms”) govern your access to AskQA (“Service”) operated by AskQA (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. The Service
AskQA is a business software platform that uses automated agents to help you discover prospects, enrich contacts, score fit, and draft outbound messages. You approve every send. We do not guarantee specific revenue, reply rates, or lead volume.
2. Eligibility
You must be at least 18 years old and authorized to act on behalf of your business. You may not use the Service for unlawful, deceptive, or abusive outreach.
3. Your account
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at viral@askqa.app if you suspect unauthorized access.
4. Your content, data, and license grant
You retain ownership of campaign configuration, lead data, and messages you create. To operate the Service, you grant AskQA a limited, non-exclusive license to:
- Host, store, process, display, and back up your data on our systems and with sub-processors
- Run AI and automation on your campaign settings to generate leads, research, and drafts
- Send email on your behalf only after you approve leads and click send, using platform delivery or SMTP you configure
- Use your business name, email, and message content in outreach you explicitly approve
- Improve reliability, security, and support for the Service (not to train unrelated public models on your data without consent)
This license ends when your data is deleted per our Data Deletion Policy, except for copies we must retain by law.
You represent that you have a lawful basis to collect and contact prospects (e.g. legitimate interest, consent, or applicable B2B rules in your jurisdiction) and that your use complies with anti-spam laws (CAN-SPAM, GDPR, CASL, etc.).
5. Plans and billing
Free and paid plans (Free, Starter, Growth, Pro, Enterprise) include monthly limits on campaign runs and sends as shown in the product. Paid subscriptions, when offered, are billed through Stripe unless stated otherwise. You may upgrade or cancel per in-app billing controls. Fees are non-refundable except where required by law or explicitly stated.
6. Acceptable use
You must follow our Acceptable Use Policy. We may suspend or terminate accounts that violate it or these Terms.
7. Third-party services
The Service may integrate with SMTP providers, CRMs, LinkedIn exports, and AI APIs. Your use of third-party services is subject to their terms. We are not responsible for third-party outages or policy changes.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-generated content may be inaccurate; you must review it before use.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKQA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD $100 IF YOU USE A FREE PLAN.
10. Indemnity
You will defend and indemnify AskQA against claims arising from your content, outreach, violation of law, or breach of these Terms.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or discontinuation. Upon termination, your right to use the Service ends. Data deletion is handled per our Data Deletion Policy.
12. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
13. Changes
We may update these Terms. Material changes will be posted on this page with an updated date. Continued use constitutes acceptance.
